2. scope of application
1.1. Für die Geschäftsbeziehung zwischen Blumen Stark, Inhaber: Rudolf Stark, Lederergasse 27, 4020 Linz (nachfolgend „Verkäufer“) und dem Kunden (nachfolgend „Kunde“) gelten ausschließlich die nachfolgenden Allgemeinen Geschäftsbedingungen in ihrer zum Zeitpunkt der Bestellung gültigen Fassung.

Die Darstellung der Produkte im Online-Shop stellt kein rechtlich bindendes Angebot, sondern eine Aufforderung zur Abgabe einer Bestellung dar. Leistungsbeschreibungen in Katalogen sowie auf den Websites des Verkäufers haben nicht den Charakter einer Zusicherung oder Garantie. Alle Angebote gelten „solange der Vorrat reicht“, wenn nicht bei den Produkten etwas anderes vermerkt ist. Im Übrigen bleiben Irrtümer vorbehalten.
3. ordering process and conclusion of contract
3.1. Der Kunde kann aus dem Sortiment des Verkäufers Produkte unverbindlich auswählen und diese über die Schaltfläche [in den Warenkorb] in einem so genannten Warenkorb sammeln. Innerhalb des Warenkorbes kann die Produktauswahl verändert, z.B. gelöscht werden. Anschließend kann der Kunde innerhalb des Warenkorbs über die Schaltfläche [Weiter zur Kasse] zum Abschluss des Bestellvorgangs schreiten.
3.2. Über die Schaltfläche [zahlungspflichtig bestellen] gibt der Kunde einen verbindlichen Antrag zum Kauf der im Warenkorb befindlichen Waren ab. Vor Abschicken der Bestellung kann der Kunde die Daten jederzeit ändern und einsehen sowie mithilfe der Browserfunktion "zurück" zum Warenkorb zurückgehen oder den Bestellvorgang insgesamt abbrechen. Notwendige Angaben sind mit einem Sternchen (*) gekennzeichnet.
3.3. Der Verkäufer schickt daraufhin dem Kunden eine automatische Empfangsbestätigung per E-Mail zu, in welcher die Bestellung des Kunden nochmals aufgeführt wird und die der Kunde über die Funktion „Drucken“ ausdrucken kann (Bestellbestätigung). Die automatische Empfangsbestätigung dokumentiert lediglich, dass die Bestellung des Kunden beim Verkäufer eingegangen ist und stellt keine Annahme des Antrags dar. Der Kaufvertrag kommt durch schriftliche Bestätigung, per E-Mail oder durch Lieferung innerhalb einer angemessenen und / oder vereinbarten Frist zustande.

4. prices and shipping costs
4.1 All prices stated on the Seller's website include the applicable statutory value added tax.
4.2 In addition to the stated prices, the seller charges shipping costs for delivery. The shipping costs are clearly communicated to the Buyer on a separate information page and during the ordering process.
5. delivery, availability of goods
5.1 Delivery will be made after receipt of the payment confirmation.
5.2 Unless otherwise agreed, delivery shall be made to the delivery address specified by the customer (Linz and surrounding area only).
If the ordered product is not accepted by the recipient, the seller has the right to invoice the delivery anyway. If the customer has not accepted the goods on the day of delivery (default of acceptance), the recipient will be notified and has the opportunity to contact the seller within five days. In this case, the seller does not guarantee the quality of the ordered products or the ordered product.
In the event that the shipment cannot be delivered due to incorrect information provided by the customer, the seller reserves the right to debit the purchase price nonetheless.
5.3 Flowers and plants are living, perishable seasonal products and vary in size, color and shape as depicted on our website. Organic products are subject to natural changes.
5.4 Customers are informed about delivery times and local delivery restrictions on a separate information page.
6. payment modalities
6.1 The customer can choose from the available payment methods during and before completing the order process. Customers are informed about the available means of payment on a separate information page.
6.2 Payment must be made in advance without deduction.
6.3 If third-party providers are commissioned with payment processing, e.g. PayPal, their general terms and conditions apply.
7. reservation of title
The delivered goods remain the property of the seller until full payment has been made.
8 Warranty for material defects and guarantee
8.1 The warranty is governed by statutory provisions.
Note: The law does not provide a warranty for fresh flowers and plants.
9. liability
9.1 The following exclusions and limitations of liability shall apply to the Seller's liability for damages, notwithstanding the other statutory requirements for claims.
Recourse claims within the meaning of Section 12 of the Product Liability Act are excluded unless the party entitled to recourse proves that the defect was caused by the seller or was at least due to gross negligence.
9.2 Insofar as the Seller's liability is excluded or limited, this shall also apply to the personal liability of employees, representatives and vicarious agents.
10. storage of the contract text
10.1 The customer can print out the text of the contract before submitting the order to the seller by using the print function of his browser in the last step of the order.
10.2 The seller shall also send the customer an order confirmation with all order data to the e-mail address provided by the customer. With the order confirmation, but at the latest upon delivery of the goods, the customer will also receive a copy of the General Terms and Conditions together with the cancellation policy and the information on shipping costs and delivery and payment terms. 11. final provisions
11.1 The place of jurisdiction and place of performance is the registered office of the seller if the customer is a merchant, a legal entity under public law or a special fund under public law.
11.2 The contractual language is German.
